摘要:

目的 分析中药材互联网经营的立法现状和监管挑战,为有效规制其经营风险提供参考。方法 通过梳理中药材互联网经营的立法、执法和司法现状,识别存在的规制难题,结合相关文献理论和司法判例,提出针对性解决策略。 结果 中药材互联网经营在质量和合规性方面面临多重挑战,传统的监管方式显得力不从心。立法体系的不完善、执法资源的分散配置以及社会监督机制的僵化,共同削弱了中药材网络综合治理的效能。结论 为保障中药材用药安全,亟需构建严密的监管法律、政策和标准框架,确保立法协调统一,并借助大数据、人工智能等技术提升监管能力。同时,应强化平台自治,引导行业协会、消费者等参与监管,构建多元协同共治的法治新模式。

Abstract:

Objective To analyze the legislative status and regulatory challenges of the online trade of traditional Chinese medicinal materials, providing references for effectively regulating its operational risks. Methods By reviewing the legislative, law enforcement, and judicial status of the online trade of traditional Chinese medicinal materials, identifying existing regulatory difficulties, and combining relevant literature theories and judicial precedents, targeted solutions are proposed. Results The online trade of traditional Chinese medicinal materials faces multiple risks such as quality and compliance, which are difficult to address with traditional regulatory methods. Issues such as chaotic legislation, dispersed law enforcement resources, and rigid social supervision channels undermine the effectiveness of comprehensive online governance. Conclusion To ensure the safety of traditional Chinese medicinal materials, it is imperative to establish a stringent regulatory legal, policy, and standard framework, ensuring legislative coherence, while harnessing technologies such as big data and artificial intelligence to bolster regulatory efficiencies. Additionally, platform autonomy should be strengthened, guiding industry associations and consumers to participate in regulation, thereby constructing a diversified and collaborative legal governance model.
